1. Who may use MySipTracker
MySipTracker is a free personal drink log operated by Chillex. Creating an account means you offer to use the app on these terms, and Chillex accepts by creating the account.
You may create an account only if you are old enough to buy and consume alcohol legally where you are, and in any case only if you are at least 16. The app is not directed at children. You use it for yourself, you give an email address you can be reached at, and you keep your password to yourself.
2. What the app is
MySipTracker stores drinks you choose to log, with an optional photo, rating, and location, and shows your own history, map, and stats. Some drink names, ratings, and notes can be shown to other signed-in people on Best drinks, as described in the privacy notice. Your username is not shown there.
The app is a notebook. It is not medical, nutritional, dietary, legal, safety, or professional advice. A barcode match, a label reading, an ABV, a product photo, a rating, a place, or a statistic can be wrong, incomplete, or out of date. Chillex does not check what is in a glass, bottle, or can.
The app is provided free of charge, as available. Chillex may change, suspend, or stop features, and does not promise that the app will be uninterrupted, error-free, or available at any particular time.
A blood alcohol figure, if the app shows one, is a rough estimate and can be wrong, too high or too low. It uses the time you added each drink, which may not be when you drank it, the size and strength on the log, including a usual guess when you leave them empty, and the sex and weight on your profile. It ignores food, medicines, illness, hormones, pace, and how fast your body clears alcohol. It treats alcohol as if it entered the blood at once and then fell at one fixed rate. It only includes drinks logged in the last 24 hours. A drink you did not log is missing. It is not a breath, blood, or urine test. You must not use it to decide whether to drive, work, swim, operate anything, or look after another person.
3. What you are responsible for
You alone decide what you drink, how much, where, and whether you then drive, walk, work, swim, operate anything, or look after another person. You follow the alcohol, age, driving, and public-order laws that apply to you. You do not rely on MySipTracker to decide if a drink is safe, legal, non-alcoholic, or suitable for you.
You are responsible for the names, photos, ratings, and places you submit. You will not upload anything illegal, anything that infringes someone else’s rights, or another person’s private information. You will not try to break, probe, or overload the app, or access an account that is not yours.
4. No warranty and limit of liability
To the maximum extent permitted by applicable law, MySipTracker is provided “as is” and “as available”, without any warranty, condition, or representation, whether express, implied, or statutory. That includes warranties of accuracy, fitness for a particular purpose, reasonable care, availability, security, and non-infringement.
To the maximum extent permitted by applicable law, Chillex and the people who develop or host MySipTracker are not liable for any loss, damage, injury, illness, death, accident, fine, prosecution, or other claim that arises out of or in connection with the app. That includes anything that follows from what you drink, from intoxication, from travel or driving, from a missed or wrong scan, from a product match, from an ABV, rating, photo, place, statistic, or blood alcohol estimate, from data that is lost or disclosed, and from the app being unavailable.
To the maximum extent permitted by applicable law, Chillex is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, even if Chillex was told those damages were possible.
Because the app is free, Chillex’s total aggregate liability for all claims relating to MySipTracker is limited to zero. If a law requires a cap that cannot be zero, the cap is the amount you paid Chillex for MySipTracker in the twelve months before the claim. That amount is nothing unless you have paid a separate fee that Chillex has agreed in writing.
You use the app entirely at your own risk and you assume every risk of logging, sharing, or relying on drink information.
Nothing in these terms limits a liability that the law does not allow a contract to limit. That includes liability for intent, for gross negligence, for injury to life, body, or health caused by Chillex, and rights that mandatory consumer or data-protection law does not let you waive.
5. You cover claims that come from your use
You will indemnify and hold harmless Chillex and the people who develop or host MySipTracker against claims, losses, damages, and reasonable legal costs brought by anyone else because of your use of the app, the drinks or content you log, your breach of these terms, or your breach of the law or of another person’s rights.
This indemnity does not apply to the extent the claim is caused by Chillex’s intent or gross negligence.
6. Your content
You keep ownership of the text and photos you submit. You give Chillex a non-exclusive licence to host, store, reproduce, and display that content only so the app can run. That includes showing a drink name and its ratings on Best drinks.
The licence ends when the content is deleted, except for copies that must be kept for a short time in backups or because the law requires it. You confirm that you have the rights you need to give this licence.
7. Privacy notice
Chillex is the controller for the personal data MySipTracker stores. You can reach Chillex through Chillex. This section tells you what is stored, why, how it is protected, and which rights the GDPR gives you.
Data that is stored
The account record holds your username, email address, a hash of your password, the time the account was created, and the time you accepted these terms. The password itself is not stored. If you add them, sex and weight are stored on your profile and used only for a blood alcohol estimate.
Each drink you save can hold the name, type, ABV, star rating, time, an optional photo, and an optional latitude and longitude. A session cookie keeps you signed in. Failed sign-in attempts are counted in that session so repeated guesses can be slowed down. That counter is not a permanent profile.
Drink logs can reveal habits. MySipTracker does not use them to judge your health, and it does not ask for medical information. Do not put health details, or another person’s private information, into a name or photo.
Why it is processed
The account and the drinks you log are processed to provide the service you ask for when you create an account. The legal basis is Art. 6(1)(b) GDPR, performance of a contract.
A photo or a location is stored only when you choose to add it as part of logging a drink. If you skip them, they are not stored. The legal basis is the same contract, Art. 6(1)(b). You can log a drink without either one.
Password hashing, the protected sign-in cookie, CSRF checks, and the short lockout after repeated failures are used to keep accounts secure. Storing the time you accepted these terms shows that you agreed. The legal basis is Chillex’s legitimate interest in running a secure service and in being able to show the agreement, Art. 6(1)(f). You can object to processing that rests on legitimate interests, as described below.
Chillex does not sell personal data, and does not use it for advertising profiles or for automated decisions that produce legal effects.
Who can see it
Your history, your map pins, your photos, and your personal stats are available to your account. Other people do not get your email, your exact location, or your photos through the leaderboards.
Best drinks shows a drink’s name, type, average rating, how many ratings it has, and how many people logged it. It does not show who drank it, your username, or where.
Other recipients
The database and photos are hosted for Chillex by World4you, which stores them as a processor. Chillex does not authorise that host to use the data for its own purposes.
When you look up a barcode or a label, your browser contacts Open Food Facts. That request leaves your device and can include the barcode or the text that was read. MySipTracker stores a product only if you then save the drink.
The app loads fonts, icons, maps, and code libraries from third-party networks, including Google Fonts, cdnjs, jsDelivr, and the hosts of Leaflet and Chart.js. Those providers can see your IP address and ordinary device data when your browser fetches the files.
Buy me a coffee and the Chillex website open only if you follow those links. Their own notices apply from then on. The share button uses your device’s share sheet. MySipTracker does not receive the list of people you send it to.
Some of those providers may process technical data, such as an IP address, outside the European Economic Area. Where that happens, the transfer rests on that provider’s legal safeguard, such as an adequacy decision or standard contractual clauses.
How long it is kept
Account data, drinks, photos, ratings, and locations are kept until you delete the drink or delete the account. Deleting the account deletes your drinks. A photo file is removed when no remaining drink uses it. A backup copy, if the host keeps one, drops out on the host’s ordinary backup cycle. The session cookie lasts until you sign out or the session ends. If you choose Stay logged in, a separate cookie on that device keeps you signed in for 30 days, or until you sign out.
Security
The password is stored only as a one-way hash. The sign-in cookie is HttpOnly and SameSite, and it is marked Secure when you use the site over HTTPS. Saves and account actions are checked with a CSRF token tied to your session. The uploads folder is set to refuse execution of scripts. Use the site over HTTPS, use a password you do not use anywhere else, and keep your device locked.
No store of data on the internet is perfectly secure. You should treat a drink log as personal, and you should not put secrets into it.
Your GDPR rights
You can ask for access to your personal data, for correction, for erasure, for restriction, and for a portable copy. You can object to processing based on legitimate interests. You can complain to a supervisory authority. These rights are free of the limits in the liability section. A contract cannot take them away.
In the app, you can delete a single drink in History, and you can delete the account and every drink under Info. To ask for a copy, to correct your username or email, to object, or to make any other request, contact Chillex through Chillex. Chillex will answer within one month, or within the longer period the GDPR allows when a request is complex, and will tell you if that extension is used.
Chillex may ask you to confirm that you control the account before releasing a copy. A request can be refused only where the GDPR itself allows a refusal, and the reason will be explained.
If Chillex is established in Austria, you can also lodge a complaint with the Österreichische Datenschutzbehörde at dsb.gv.at. If you live in another country of the European Economic Area, you can complain to the authority where you live.
8. Ending use
You may delete your account at any time under Info. Deletion removes the account and the drinks stored with it, and it cannot be undone. Chillex may suspend or close an account that breaks these terms, breaks the law, or puts the service or other people at risk. When the account ends, your licence to use the app ends. Sections that by their nature should survive, including liability, indemnity, and this privacy notice as it applies to any data still held, stay in effect.
9. Changes
Chillex may update these terms by posting a new version on this page with a new date. The time stored on your account is the time you accepted the version then published. If you keep using MySipTracker after an update is posted, you accept the updated terms to the extent the law allows that form of acceptance. A change does not reduce rights you already have under data-protection law.
10. Law, disputes, and the rest of the contract
These terms are governed by the law of Austria, excluding its conflict-of-law rules. If you are a consumer in the European Economic Area, the mandatory consumer-protection rules of the country where you live still apply.
If you use MySipTracker as a business, the courts at Chillex’s place of establishment have exclusive jurisdiction. If you are a consumer, you may bring a claim in the courts the law reserves to you, including the courts of your place of residence, and Chillex may sue you only in those courts.
Contact Chillex through chillex.cloud before you start a formal dispute, so there is a chance to resolve it directly.
If a court holds one part of these terms unenforceable, that part is reduced to the strongest version the law still allows, and the rest stays in force. These terms, including this privacy notice, are the whole agreement between you and Chillex about MySipTracker. They replace earlier statements about the same subject.
